Terms of service.

By accessing or using WorqSphere, you agree to these Terms and any order form, subscription agreement, data processing agreement, or policy incorporated by reference. If you use the platform on behalf of an organization, you represent that you have authority to bind that organization.

WorqSphere provides cyber-defense software for security visibility, incident reconstruction, investigation, response and authorized assessment. Access is provided according to the subscribed plan, configured permissions, and applicable documentation.

You are responsible for maintaining accurate account information, protecting credentials, and ensuring authorized users comply with these Terms.

Customers retain ownership of the data they submit to the platform. Customers are responsible for the legality, accuracy, quality, and authorization of customer data, including employee notices, workplace policies, and consent requirements where applicable.

Customers are responsible for configuring roles, permissions, retention settings, work policies, and security controls appropriate for their organization.

You may not use WorqSphere to violate laws, infringe rights, interfere with service integrity, attempt unauthorized access, reverse engineer the platform, transmit malicious code, or process information without lawful authority.

The platform must be used in a professional, transparent, and policy-governed manner consistent with applicable employment, privacy, and data protection requirements.

Fees, billing cycles, renewal terms, and payment obligations are described in the applicable order, checkout, or subscription agreement. Unless otherwise stated, fees are non-refundable except where required by law or expressly agreed in writing.

We may suspend access for overdue payment, security risk, or material violation of these Terms after reasonable notice where practical.

Each party may receive confidential information from the other. Confidential information must be protected using reasonable care and may only be used to fulfill obligations under the applicable agreement. Confidentiality obligations do not apply to information that is public, independently developed, or lawfully received without restriction.

WorqSphere maintains administrative, technical, and organizational safeguards designed to protect the platform. We may update, improve, or modify services to maintain security, reliability, performance, and compliance.

We do not guarantee uninterrupted service. Planned maintenance, emergency maintenance, third-party failures, and circumstances outside our control may affect availability.

WorqSphere and its licensors retain all rights in the platform, software, documentation, designs, trademarks, and related technology. Customers receive a limited, non-exclusive, non-transferable right to use the platform during the subscription term.

The platform is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, WorqSphere will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenue, goodwill, or data. Our aggregate liability is limited to the amounts paid for the service during the twelve months before the event giving rise to liability.

Either party may terminate access according to the applicable subscription agreement. We may suspend or terminate access for material breach, security risk, non-payment, or unlawful use. Upon termination, customer access may end and data may be retained or deleted according to the agreement, law, and retention policies.

We may update these Terms from time to time. Material changes will be communicated through the platform, email, or website notice. Continued use after changes become effective constitutes acceptance of the updated Terms.
